1. Agreement to Terms

By accessing or using Estima (the "Service"), operated by LAZO ("we", "us", or "our"), you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

LAZO is an independent one-person studio that builds and operates its own products. Estima is one of them. There is no company behind it, and no support department: the address in section 23 is read by the person who built the Service.

We may modify these Terms at any time. Your continued use of the Service following any modification constitutes acceptance of the revised Terms, and the date above always reflects the current version. If you do not agree with a modification, your sole remedy is to stop using the Service and delete your account.

2. Description of Service

Estima analyses photographs you upload in order to estimate two things: the shape of your face, and your natural colouring. From those estimates it presents styling suggestions drawn from our own curated reference data, including a seasonal colour type, a palette of colours with hex codes, colours to avoid, neutrals, combinations, metals, and hair colour suggestions.

The estimate is produced by an automated system. The suggestions built on top of it are not produced by that system: they are read from a fixed reference table that we maintain, which is why the same readings always produce the same suggestions.

The Service is provided for styling, self-knowledge and entertainment purposes only. It does not score, rate, rank or compare users. Face shape is a shape, not a grade, and a colour season describes which colours sit well next to your own colouring. Nothing in the Service is a measurement of attractiveness, worth, health or ability.

3. Styling Tool, Not Advice

THE SERVICE IS NOT A MEDICAL, DERMATOLOGICAL, PSYCHOLOGICAL, COSMETIC-SURGICAL, OR OTHER PROFESSIONAL SERVICE, AND DOES NOT PROVIDE PROFESSIONAL ADVICE OF ANY KIND.

You expressly acknowledge and agree that:

The Service does not diagnose, treat, assess or screen for any condition of your skin, hair, eyes or general health, and is not a substitute for a qualified dermatologist, physician, colourist, stylist or other professional
Readings such as undertone, depth, contrast and chroma are descriptions of appearance in photographs, not clinical or biometric determinations
Haircuts, hair colour, cosmetic treatments, clothing and purchases you make after using the Service are entirely your own decisions, and we are not responsible for their outcome or cost
If a photograph raises a health concern to you, take it to a professional, not to us

4. Eligibility

To use the Service you must be at least 18 years of age. This is higher than the age of digital consent under Article 8 of the EU General Data Protection Regulation, and it is deliberate: the Service processes photographs of faces and transmits them to a third-party provider, and we keep that to adults.

You confirm your age before your first scan. If we learn that a user is under 18, we will close the account and delete the associated data. You may not create an account on behalf of anyone else, and you may not let a minor use your account.

We reserve the right to refuse or terminate access to the Service at our discretion.

5. User Accounts

You sign in with Google. We never see or hold your Google password. You are responsible for keeping access to that Google account secure and for everything done through your Estima account, and you agree to notify us at support@lazo.build of any unauthorised use. One person, one account.

Your results are private to your account by default. Estima has no public profiles, no leaderboards and no social feed, and nothing about you is published unless you publish it.

You can create a share link for a single reading. It is off until you switch it on, it shows only your colour season and its five colours, and it contains no photograph, no face shape and no name. Anyone holding the link can open it without signing in, which is what it is for. You can switch it off at any time and the link stops working permanently. See the Privacy Policy for the detail.

6. Acceptable Use

You agree NOT to:

Upload a photograph of anyone other than yourself, whether or not that person consented
Upload a photograph of any person under 18, in any circumstance
Upload images you do not have the right to use, or content that is unlawful, explicit, hateful or intended to harass anyone
Work around usage limits, cooldowns or quotas, including by creating multiple accounts, clearing identifiers, or rotating addresses
Automate access to the Service, or send images that do not contain a face in order to probe its behaviour
Scrape, copy or redistribute our reference data, palettes or recommendation logic, or reverse engineer the Service
Interfere with, disrupt or gain unauthorised access to the Service or its infrastructure

Violation may result in immediate suspension or termination of your account and access, without notice and without refund.

7. Your Photographs

You keep all rights to your photographs. You represent that each photograph you upload is of yourself and that you have the right to use it.

By uploading, you grant LAZO a limited, non-exclusive, worldwide, royalty-free licence to process that photograph solely to produce your result, as described in section 8. That licence lasts only for the duration of the processing and ends when the processing does. We do not use your photographs for training, marketing, or any other purpose, and we do not share them with anyone other than the provider named in section 8.

Your individual results are yours to keep, export and share.

8. How Photographs Are Processed

Your photographs are processed in memory to produce your result and are then discarded. They are never written to disk, never placed in storage, and never attached to your account. What we keep is the reading itself and the result built from it, which is described in the Privacy Policy.

To produce that reading, your photographs are transmitted to the Google Gemini API. Google is an independent provider operating under its own terms, and this is the one part of the process that is not in our hands.

Estima currently runs on Google's free service tier. Under Google's Gemini API Additional Terms of Service, on that tier Google may use submitted content to provide, improve and develop its products, services and machine learning technologies, and human reviewers may read, annotate and process the input and the output. If you are in the European Economic Area, Switzerland or the United Kingdom, Google states that it applies its paid-service data terms to all use, including free quota.

We tell you this before you upload rather than afterwards. By uploading, you consent to that transmission and to Google's handling of it. If you are not comfortable with it, do not upload photographs.

9. Accuracy and Limits of the Reading

The reading is an estimate produced by an automated system from photographs, and you acknowledge that:

Lighting, camera, shadow, filters, makeup, hair colouring and the angle of a shot all change what the system sees, and two photographs of the same person taken in different conditions can produce different readings
Automated analysis is imperfect and may be wrong. A reading is a description of an image, not a statement about you
Where the system is unsure, the Service says so rather than presenting a confident answer, and where you disagree with a reading you can tell us so, and say why if you want to
We may change, improve or replace the reference data and the rules that turn readings into suggestions at any time, and a later scan may therefore differ from an earlier one

10. Availability, Capacity and Usage Limits

The Service depends on a third-party provider with finite capacity, and that capacity is shared by everyone using Estima. We therefore apply usage limits per account, per device and across the Service as a whole, and we may queue, delay, limit or temporarily suspend scans, including for free users, in order to stay within it.

Repeatedly submitting images that contain no face may result in a temporary cooldown.

We do not promise any level of uptime, throughput or turnaround time, and we may modify or discontinue any part of the Service at any time.

11. Free and Paid Plans

Part of the Service is free, subject to the usage limits described above, which we may change at any time. There are no paid plans yet. When there are, what is included and what it costs will be stated in front of you before you pay.

When payments go live they will be processed by Paddle.com Market Limited ("Paddle"), acting as Merchant of Record. Paddle is the legal seller of record for your purchase, and calculates and collects applicable taxes. Your purchase will also be subject to Paddle's own terms and privacy policy. Refunds are covered by our Refund Policy.

12. Intellectual Property

The Service, including its reference data, colour palettes, recommendation logic, text, design and software, is and remains the exclusive property of LAZO and its licensors. The curated reference data is the product, and it is not licensed to you.

These Terms grant you only a limited, non-exclusive, non-transferable right to use the Service for your own personal purposes, and no other right, title or interest.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LAZO DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE, ITS READINGS OR ITS SUGGESTIONS ARE ACCURATE, RELIABLE, COMPLETE OR TIMELY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE. AUTOMATED READINGS MAY CONTAIN ERRORS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL LAZO, ITS OPERATORS, OWNERS, AGENTS OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL OR OPPORTUNITY, ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, INCLUDING ANY DECISION YOU TAKE ON THE BASIS OF A RESULT.

THE TOTAL AGGREGATE LIABILITY OF LAZO FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE LESSER OF: (A) THE TOTAL AMOUNT YOU PAID FOR THE SERVICE IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY EUROS (€50).

These limitations apply regardless of the legal theory on which a claim is based. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory statutory rights of consumers. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS; IN THOSE JURISDICTIONS OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

15. Indemnification

You agree to defend, indemnify and hold harmless LAZO and its operators, owners, agents and affiliates from any claims, damages, losses, liabilities and expenses, including reasonable legal fees, arising from your use of the Service, your violation of these Terms or any law, or your violation of any third-party right.

This applies in particular to any claim relating to a photograph you uploaded that was not of yourself. That obligation survives termination of your account and of these Terms.

16. Data Handling

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you acknowledge that your photographs are transmitted to a third-party AI provider as described in section 8, and that the resulting readings are stored under your account until you delete them.

17. Third-Party Services

The Service relies on third-party providers: Google for image analysis, Supabase for the database and sign-in, and Vercel for hosting. Payments, when they exist, will be handled by Paddle as Merchant of Record. We are not responsible for and make no warranties regarding any third-party service, and your use of them is subject to their own terms.

18. Termination

You may stop using the Service and delete your account at any time from the settings page. Deletion removes your profile, every scan you have run and your sign-in record, and it is immediate and irreversible.

We may suspend, restrict or terminate your access at any time if you breach these Terms, if we are required to by law, or if we discontinue the Service. Sections 12 through 15, and section 20, survive termination.

19. Force Majeure

LAZO is not liable for any failure or delay in performing its obligations resulting from events beyond our reasonable control, including natural disasters, war, civil unrest, government action, internet or telecommunications outages, power or server failures, cyber attacks, or the failure, withdrawal or rate limiting of third-party services on which the Service depends.

20. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Montenegro, where the Service is operated from, without regard to conflict-of-law provisions. Any dispute arising out of or in connection with these Terms or the Service is subject to the exclusive jurisdiction of the courts of Montenegro, and you irrevocably submit to that jurisdiction. Nothing in this section deprives you of the protection of mandatory consumer-protection law in your country of residence.

Before starting any formal proceedings, both parties agree to attempt to resolve the dispute through good-faith written correspondence for a period of thirty (30) days from the date of the first written notice.

21. Severability

If any provision of these Terms is found unlawful, void or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions continue in full force.

22. Entire Agreement

These Terms, together with the Privacy Policy, the Refund Policy, the Cookie Notice and the Disclaimer, constitute the entire agreement between you and LAZO with respect to the Service and supersede all prior understandings. Any failure by LAZO to assert a right or provision under these Terms is not a waiver of it.
